Member of Council Legislative Assembly (MCLA), BTC, Arpana Das who won Salakati (ST) seat backed by Janagostiya Aikya Mancha, on Monday appeared before a district court here following the summon which sought her legal position of being ST.Tribal leader of Kokrajhar, DD Narzary who is associated with Janajati Suraksha Moncha informed that Arpana Das was summoned by the district court on her legality of being ST and accordingly she appeared before the court on Monday. He said that Das sought time to furnish her written documents of being ST till July 4. He also said that another MCLA from Guma constituency, Aminur Islam has also been served summon notice to appear before the court on June 11. Narzary demanded that the government should take strong measures against violation of the guidelines of the Election Commission and tribal reserved seats.Janajati Suraksha Mancha (JSM) has filed cases against the two BTC MCLAs challenging their eligibility to contest in the last BTC poll.
The JSM alleged that Arpana Das, an MCLA from 12 No. Salakati (ST) constituency was not a tribal and belonged to Sarania community which as yet has not been declared as a tribal community.A case (No. 18/2015) was also registered against the MCLA Arpana Das filed by Ranendra Muchahary of Samgaon villagein Kokrajhar on May 7. It alleged that Das had procured ST caste certificate under the garb of Boro Kochary community and contested the BTC election in ST seat which was illegal as per BTC Election Rules, 2014.The JSM also filed a case against the MCLA Aminur Islam of 2 No. Guma (Open) constituency challenging that Islam was neither a voter of the constituency nor from BTC. Lohit Chandra Basumatary, a voter of Guma constituency filed a case on May 8 against discrepancy regarding the MCLA’s voter list while contesting the BTC election.
JSM activists headed by Janaklal Basumatary, Daorao Dekhreb Narzary and Ashok Brahma demanded disqualification of the two MCLAs citing that they had furnished wrong documents to contest in the BTC election while violating the BTC Election Rules, 2014. They also alleged that the Assam Government had not taken sincere measures during the BTC election, 2015 and unscrupulous elements had taken advantage of this situation(The Sentinel, KOKRAJHAR, 8 June 2015).
